Terms and Conditions of Sale

1. Preamble and definitions

These Terms and Conditions of Sale ("Terms") govern the purchase of digital credits from Hopper for Gaming through hopperforgaming.com and related sub-domains. By placing an order you accept these Terms.

  • "Company" / "we" — Hopper for Gaming, a sole proprietorship registered in Israel under number 300316635, Hapalmah 11, Givatayim, Central District, Israel.
  • "Customer" / "you" — any person or entity purchasing Credits.
  • "Credits" — the prepaid digital units consumed when using paid features of the Service.
  • "Payment Provider" / "Merchant of Record" — Paddle, which sells the Credits to you as reseller and processes payment, tax, and invoicing on our behalf.

3. Products and scope

We sell digital Credits only — one-time credit packs, delivered electronically. There are no physical goods, shipping, or delivery. We do not currently sell recurring subscriptions. These Terms apply to all Credit purchases regardless of the Customer's location.

To purchase Credits you must be at least 18 years old and have the legal capacity to enter into a contract. By placing an order you confirm that you meet these requirements.

4. Merchant of Record

Payments are handled by Paddle as our Merchant of Record. This means Paddle is the reseller of record for your purchase and is responsible for processing payment, collecting and remitting applicable taxes (e.g. VAT/GST), and issuing your invoice. Your purchase is therefore also subject to Paddle's Buyer Terms, in addition to these Terms.

5. Prices and payment

Prices are shown inclusive of applicable taxes (Paddle calculates and adds or includes the correct tax based on your location at checkout) and in the applicable currency. We may change prices at any time, but changes do not affect orders already confirmed.

Accepted payment methods are those offered by Paddle at checkout, which typically include credit/debit card, PayPal, Apple Pay, and Google Pay, and may vary by region. All payment data is collected and processed securely by Paddle; we do not receive or store your card details.

6. Order process and delivery

You select a credit pack in the app and complete payment through Paddle's secure checkout. On successful payment, the Credits are added to your account balance immediately, and Paddle issues a receipt/invoice. Completion of this process concludes our delivery obligation; there is no physical delivery.

7. Right of withdrawal and refunds

Credits are digital content supplied immediately. By completing your purchase, you expressly request immediate performance and acknowledge that you lose any statutory right of withdrawal once the Credits are made available to your account. Accordingly, purchased Credits are non-refundable, except where a refund is required by applicable law. Where a refund is granted, it is processed by Paddle to your original payment method. Nothing in this section limits your mandatory statutory consumer rights.

8. Warranties

We provide the legal warranties required by applicable consumer law; the Credits and Service will materially conform to their description. We do not offer any additional commercial warranty. The legal warranty does not cover issues arising from misuse or from factors outside our control.

9. Liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, punitive, or consequential damages, or for loss of profits, data, or goodwill, arising from any failure of performance, error, omission, interruption, defect, or delay in operation or transmission. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your mandatory statutory consumer rights. Subject to the foregoing, our total liability for any claim relating to a purchase is limited to the amount you paid for that purchase.

10. Force majeure

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, governmental action, strikes, pandemics, or failures of third-party infrastructure. We will make reasonable efforts to resume performance promptly.

11. Intellectual property

All content and software of the Service are owned by Hopper for Gaming or its licensors. Purchasing Credits grants you the right to use the paid features of the Service; it does not transfer any intellectual-property rights.

12. Personal data

We process personal data in connection with your purchase in accordance with our Privacy Policy. Payment data is collected and processed by Paddle as Merchant of Record; we do not store card details. International transfers to service providers in the United States are protected by Standard Contractual Clauses and, where applicable, the EU-U.S. Data Privacy Framework.

13. Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. If a dispute arises, you agree to first contact us at henlachmani@hopperforgaming.com so we can try to resolve it informally in good faith within 30 days. If it remains unresolved, the competent courts of Tel Aviv, Israel shall have exclusive jurisdiction — except where mandatory consumer-protection laws of your country of residence provide otherwise. The parties may also agree to voluntary mediation, sharing its costs equally unless agreed otherwise. Billing, refunds, and chargebacks may additionally be handled through Paddle under Paddle's Buyer Terms. Nothing here affects your mandatory statutory consumer rights.
